TERMS AND CONDITIONS
The following terms and conditions are included to demonstrate that this website
meets the requirements of the:
• Consumer Protection (Distance Selling) Regulations 2000
• Electronic Commerce (EC Directive) Regulations 2002
• Disability Discrimination Act 1995 (through Bobby A compliance under
the W3C Accessibility guidelines).
The following information is provided here, together with the details on the
'contact us' page, to comply with the requirements of the Consumer Protection
(Distance Selling) Regulations 2000. The term 'book' here refers to Leading
Your People To Success. Books are each priced at £14.99 plus £2.75
postage and packaging for UK orders or £8.83 postage and packaging for
overseas orders. This book price will remain in force until and unless the
retail price is changed by the publisher. The postage price charged will be
that shown on the web site when the order is placed. The book, and its associated
packaging and postage, is zero rated for VAT purposes. The cost for postage
and packaging covers second class, recorded delivery, worldwide in a padded
protective envelope. Delivery timing depends on the service provided by the
postal system, and also the destination address, but should normally be within
48 hours of posting for UK deliveries. Books will normally be posted on the
same day as payment is received. Payment may be made by credit or debit card
through the secure payment services provider NetBanx. Alternatively, books
ordered by requesting a proforma invoice will need payment (e.g. cheque) to
be received and cleared before posting. The purchaser has the right to cancel
the order within 7 days of receiving the book, but must do so in writing (e.g.
by e-mail) and must also return the book at the purchaser's expense, so that
it is received in saleable condition. On receipt of the returned book, subject
to the above conditions, a full refund will be made within 30 days of receiving
the written notice of cancellation. When an order has been received, written
order confirmation will normally be sent by e-mail the same day. This order
confirmation will confirm your right to cancel the order within 7 days, and
what to do to obtain a refund.
The Electronic Commerce (EC Directive) Regulations 2002 apply to goods or services
sold to businesses or consumers online. The requirements contained in these
regulations divide into three categories; information requirements, commercial
communications, and electronic contracting.
The information requirements ask for details of relevant trade organisations
to which you belong, any authorisation scheme relevant to your online business,
and full contact details of your business. Leading Your People To Success Ltd
does not belong to any trade organisations, or authorisation scheme, simply
because we have yet to find any that are relevant to our business; and the
'contact us' page provides you with our contact details.
The information requirements also extend to the following VAT and pricing notifications,
given that the goods and services sold online by Leading Your People To Success
Ltd may in the future include products and/or services subject to VAT. With
these future sales in mind, there is a pre-emptive requirement to include VAT
information on this website. Leading Your People To Success Ltd is VAT registered,
with VAT number 772 5156 21.
The regulations also specify the need for clear prices, including any delivery
or tax charges; all of which is already incorporated into the relevant book
ordering pages.
Under the commercial communications requirements, Leading Your People To Success
Ltd will provide clear identification of:
• electronic communications designed to promote our goods and services
(e.g. e-mails);
• the person on whose behalf they are sent;
• any promotional offers advertised electronically;
• any qualifying conditions regarding such offers;
• any unsolicited commercial communications sent electronically.
Leading Your People To Success Ltd may use your contact information to send
you details of other products and services, unless you have ticked the box
in the ordering process indicating that you do not wish to receive further
information.
The electronic contracting requirements include providing end users with:
• a description of the different technical steps to be undertaken to conclude
a contract on line;
• an indication of whether the contract will be filed by Leading Your People
To Success Ltd, and whether it can be accessed;
• details of how to correct inputting errors;
• the languages offered in which to conclude the contract.
Clear guidance notes accompany each order process to enable one or more books
to be purchased online, together with the facility to correct inputting errors.
Contracts are currently available in the English language only. Customers purchasing
online will have non-sensitive data (e.g. name and address) recorded manually
in an offline database.
This website has been designed to try and incorporate the main principles behind
The Disability Discrimination Act 1995. This is 'An Act to make it unlawful
to discriminate against disabled persons in connection with employment, the
provision of goods, facilities and services or the disposal or management of
premises; to make provision about the employment of disabled persons; and to
establish a Disability Rights Commission.'
Taking the principles of the Disability Discrimination Act through to 'the
electronic provision of goods, facilities and services', the following information
is attributed to the http://bobby.watchfire.com website. 'Bobby tests web pages
using the guidelines established by the World Wide Web Consortium (W3C) Web
Access Initiative (WAI) as well as Section 508 guidelines from the Architectural
and Transportation Barriers Compliance Board (Access Board) of the U.S. Federal
Government.'
There are three levels of compliance: Bobby A, Bobby AA, and Bobby AAA. The
Bobby A compliance (see logo on home page) indicates that this site meets the
requirements for the first (minimum) level of access by individuals with disabilities.
